Court steps in to protect actor’s digital identity

In a significant move, the Delhi High Court has granted interim relief to Varun Dhawan, directing the removal of AI-generated deepfakes, unauthorised merchandise, and other content misusing his name and image. Justice Jyoti Singh passed the order on May 29, noting that the actor had established a prima facie case for protection of his personality rights.

The court observed that some of the material included AI-generated images and videos showing Dhawan in inappropriate situations, including pornographic content. The judge remarked that such distasteful content harms the actor’s reputation and could mislead the public into believing what is depicted may be true.

Represented by Senior Advocate Sandeep Sethi, Dhawan’s legal team highlighted that several online sellers were marketing merchandise using his identity without permission. The suit also mentioned booking agencies allegedly claiming to secure Dhawan’s presence for events without authorisation.

What the court order covers

The High Court restrained various websites, e-commerce platforms, and social media intermediaries from violating Dhawan’s publicity and personality rights. The order prohibits the use of the actor’s name, image, voice, likeness, signature, or any other identifiable attribute for commercial or personal gain without authorisation.

Major tech companies including Google, Meta Platforms, and X Corporation have been directed to provide Basic Subscriber Information of users allegedly responsible for sharing the infringing content. Social media intermediaries must remove any newly identified infringing material within 36 hours of being notified by the actor.

The actor has secured trademark registration for both his name and signature. The suit contends that unauthorised use of these identifiers amounts to infringement and creates confusion among consumers.

Growing legal battle against AI misuse

This ruling marks another judicial intervention in the debate surrounding artificial intelligence and celebrity identity protection. As AI-generated content becomes more sophisticated, Indian courts are increasingly addressing concerns about reputation, privacy, and personality rights.

For now, the Delhi High Court’s ruling provides Dhawan with interim protection while the matter continues to be heard. The actor’s legal team says they will continue to pursue the case to ensure comprehensive safeguards against digital exploitation.
